Our Process

Step 1: Preparation and Documentation

Before launching a property sale, we gather detailed information and all necessary documentation. We evaluate your property’s unique features and any recent renovations to highlight its appeal. Next, we estimate its market value by analysing recent sales of comparable properties, including asking prices and actual transaction amounts; we use real estate databases to simplify this, ensuring your property’s price is in line with current market trends.

Once the valuation is complete, we produce a sales mandate contract that outlines costs and terms clearly. We will also obtain an energy certificate and habitation licence from you where applicable and ensure we have other essential documents from you, including utility bills, and tax receipts and title deeds because the property must be physically reflected correctly in your deeds before the sale to meet legal requirements.

Step 2: Marketing the Property

Effective marketing starts with prepping the property to look inviting and neutral, helping potential buyers imagine themselves in the space. We will guide you through how to declutter clean and make minor repairs as needed. This step will show the property as well-maintained and welcoming.

Professional photos are crucial for capturing interest. Our skilled photographers will showcase the property’s best features, highlighting space and light to make a strong first impression. Aside from traditional still photographs we also use drone videos, 3D video tours and promotional videos on social media, presented by the sales team. Once the property is ready, it’s added to our website and all major international real estate portals with descriptions in multiple languages to broaden its reach. Online listings are supplemented with social media advertising, a weekly newsletter, and collaborations with other national and international agents to maximise visibility and speed up the sale.

Step 3: Property Viewings and Offers

The next step involves scheduling viewings and considering offers. Grupo Garcia agents will be well-versed in the property’s details so they can answer questions and ensure potential buyers feel confident in their choice. Of course, we also qualify potential buyers as much as possible to ensure we are bringing truly viable buyers that will fit your property.

Grupo Garcia will present the offer, including price and dates, to the seller, explain the whole process and be on hand to answer any questions and walk buyers and sellers through the entire process.

Step 4: Contracts and Reservation Fees

Once a buyer is ready to proceed, a reservation contract is drawn up, marking the property as “reserved” for them. The buyer then pays a reservation fee, which temporarily removes the property from the market, typically for 3 weeks. The buyer will use this time to conduct thorough inspections, usually using a legal advisor to check the status of the property and prepare the next step.

The next step, before the reservation period expires is the The Private Purchase Contract often called “Arras” or “Contrato de Compra venta” with the buyer providing a 10% down payment (inclusive of the reservation fee) toward the total purchase price paid directly to the seller’s account. This contract details any special conditions or agreements and states the date of completion.

Step 5: Final Transfer and Closing Costs

Quite often the buyer and/or seller will appoint legal representatives with power of attorney who will meet at the notary’s office for the completion. This negates the need for either party to travel here and makes life easier. But it’s not always the case and we have happy moments at the notary when buyers and sellers meet to exchange payment for ownership. Here, the notary confirms the property’s legal standing, payments and transfers ownership to the buyer.

The buyer often pays the final balance through the notary, who deducts relevant fees and taxes before distributing the remainder to you. Non-residents will receive 97% of the final sale amount, with 3% retained by the Spanish tax authority. This amount serves as security for unpaid taxes and if none are owed, it will be refunded.

The final step is handing over the keys and ensuring the property is in the agreed condition. Non-residents pay a capital gains tax rate of 19% on profits, while residents may pay 19-23% based on earnings BUT pay no capital gains at all if another property is bought within a year.
