It May Still Be Registered Against Your Property in Spain

One of the most common questions when selling a property is whether paying off your mortgage means that your home is automatically free of mortgage charges. The answer is: not necessarily.

In Spain, there is an important distinction between paying off a mortgage loan and formally cancelling the mortgage at the Land Registry (Registro de la Propiedad).

Although these procedures are related, they are two separate processes. Understanding the difference is particularly important if you are planning to sell your property.

1. Financial Cancellation: When You Finish Paying Off Your Mortgage

Financial cancellation occurs when the property owner has fully repaid the mortgage loan to the bank.

Once all outstanding amounts have been settled, the bank must provide, upon request, a zero-debt certificate (certificado de deuda cero), confirming that the mortgage loan has been fully repaid.

However, there is an important detail that many property owners are unaware of:

Paying off your mortgage does not mean that it automatically disappears from the Spanish Land Registry.

Even though the debt no longer exists, the mortgage may still appear as a registered charge against the property.

2. Land Registry Cancellation: Formally Removing the Mortgage Charge

To ensure that the mortgage no longer appears as an existing charge at the Land Registry, an additional procedure is generally required.

This involves formally cancelling the mortgage through a public deed executed before a Spanish notary and subsequently registering the cancellation at the relevant Land Registry.

The usual procedure involves the following steps:

Request a zero-debt certificate from the bank, confirming that the mortgage loan has been fully repaid.

Arrange for a mortgage cancellation deed to be executed before a notary, with the participation of an authorised representative of the bank.

Complete the necessary tax formalities, bearing in mind that mortgage cancellation deeds are generally exempt from the variable Stamp Duty charge (Actos Jurídicos Documentados).

Submit the cancellation deed to the Land Registry to request the formal removal of the mortgage charge.

Once the cancellation has been registered, the mortgage will no longer appear as an existing charge in the property’s Land Registry records.

3. What Happens If I Want to Sell My Property but Still Have an Outstanding Mortgage?

This is a very common situation in Spanish property transactions.

Imagine that a property owner wants to sell their home for €350,000, but still has an outstanding mortgage balance of €80,000.

Can they sell the property?

Yes. Having an outstanding mortgage does not necessarily prevent a property from being sold.

In these circumstances, one of the most common solutions is to use part of the purchase price to repay the outstanding mortgage debt.

Following our example:

The buyer purchases the property for €350,000.

Of this amount, €80,000 is used to repay the outstanding mortgage debt directly to the bank, according to the updated settlement statement.

The seller receives the remaining €270,000, subject to any agreed expenses, retentions or adjustments.

The transaction must be carefully coordinated with the bank and the notary, ensuring that appropriate arrangements are in place to guarantee the subsequent cancellation of the mortgage at the Land Registry.

This allows the buyer to acquire the property with the necessary legal safeguards to ensure that the existing mortgage charge is removed.

4. Why Is It Important to Check Registered Charges Before Buying a Property?

Before completing a property purchase, one of the most important documents to review is the Land Registry extract, commonly known in Spain as a nota simple.

This document provides information about the registered ownership of the property and any existing registered charges.

If a mortgage appears on the property, it is essential to determine whether the loan remains outstanding or whether it has already been fully repaid and only the formal Land Registry cancellation is pending.

This distinction is important because each situation requires different steps.

It is also advisable for the preliminary purchase agreement, commonly known as a contrato de arras, to expressly establish the seller’s obligations regarding the cancellation of existing charges.

The agreement should also include appropriate safeguards to ensure that these obligations are fulfilled before or upon execution of the public deed of sale.

5. The Importance of Legal Advice When Buying or Selling a Property

Buying or selling a property involves much more than simply agreeing on a price and signing the deed before a notary.

Reviewing the property’s legal and Land Registry status, identifying existing charges and ensuring their proper cancellation are essential steps in avoiding future complications.

At Grupo García, we guide our clients throughout the buying and selling process, paying particular attention to the documentation and legal circumstances that may affect each property transaction.

Are you thinking of buying or selling a property on the Costa Blanca?

Contact Grupo García. We will help you navigate your property transaction with confidence, transparency and peace of mind.

One of the most common questions when selling a property is whether paying off your mortgage means that your home is automatically free of mortgage charges.
